Acceptance of Terms

City Information Services ("CIS") is a product of Nyros Technologies ("Nyros") and www.inkakinada.com ("InKakinada") is operated by CIS.

InKakinada provides a collection of online resources, including Classified listings, Advertising, for Sale, for Rent, Movies, Discounts, Events (referred to hereafter as "the Service") available at the URL http://www.InKakinada.com/ (the "Site"), that are subject to the following Terms of Use ("Terms"). By using the Site or the Service in any way, you agree to comply with these Terms. In addition, when using particular InKakinada services, you agree to abide by any applicable posted guidelines for those services, which may change from time to time. Should you object to any term or condition of these Terms, any guidelines, or any subsequent modifications thereto or become dissatisfied with InKakinada in any way, your only recourse is to immediately discontinue use of the Site and the Service. Registration

User Conduct

• Contains personally identifiable information about another member that is published without their express consent.
• Contains material originally posted by another member that is reposted without permission or attribution.
• Has misleading email addresses or other manipulated identifiers to disguise its origin.

Is purposefully posted in an irrelevant category or city, repeatedly post the same or similar Content or otherwise impose an unreasonable or disproportionately large load on InKakinada's infrastructure

Additionally, you agree not to:

• Contact anyone who has asked not to be contacted "Stalk" or otherwise harass anyone
• Impersonate any person or entity or falsely state or misrepresent your affiliation with another person or entity
• Use automated means, including spiders, robots, crawlers, data mining tools, or the like to download data from the Site

Attempt to gain unauthorized access InKakinada computer systems or networks to engage in any activity that disrupts, diminishes the quality of, interferes with the performance of, or impairs the functionality of, the Service or the Site

No Spam Policy

You understand and agree that sending unsolicited email advertisements to InKakinada email addresses or through InKakinada computer systems, which is expressly prohibited by these Terms.

Any unauthorized use of InKakinada computer systems is a violation of these Terms and certain laws, including without limitation, the Computer Fraud and Abuse Code, Such violations may subject the sender and his or her agents to civil and criminal penalties.

CIS and InKakinada logos, icons and other marks identifying InKakinada services or products are trademarks of CIS and may not be used without prior written permission. Except as otherwise expressly set forth in these Terms, you may not copy reproduce, distribute, or create derivative works of the Service or the Site without InKakinada's express written authorization. All rights not expressly granted in these Terms are reserved to CIS.

InKakinada respects the intellectual property rights of others and expects users of the Site to do the same. You may not post, distributed, or reproduce in any way any copyrighted material, trademarks, or other proprietary information that you do not have legal authorization to use. If you believe that through the Service your work has been copied in a way that constitutes copyright infringement, or that your intellectual property rights have been otherwise violated, please immediately notify us at support@inkakinada.com.

Dealing with Organization and Individuals

InKakinada shall not be liable for your interactions with any organizations and/or individuals found on the Site or through the Service. This includes, but is not limited to, payment and delivery of goods and services, and any other terms, conditions, warranties or representations associated with such dealings. These dealings are solely between you and such organizations and/or individuals. You agree that InKakinada is not responsible for any damage or loss incurred as a result of any such dealings. NEITHER INKAKINADA, NOR ITS LICENSORS OR SUPPLIERS MAKE ANY WARRANTY THAT THE SITE, THE SERVICE OR THE CONTENT WILL MEET YOUR REQUIREMENTS, OR THAT THE SITE OR THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE; NOR DOES INKAKINADA ITS LICENSORS OR SUPPLIERS MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE OR AS TO THE ACCURACY, TRUTHFULNESS OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE SERVICE OR THAT DEFECTS IN THE SITE WILL BE CORRECTED. Indemnity

YOU HEREBY AGREE, AT YOUR EXPENSE, TO INDEMNIFY, DEFEND AND HOLD INKAKINADA HARMLESS FROM AND AGAINST ANY LOSS, COST, DAMAGES, LIABILITY, AND/OR EXPENSE ARISING OUT OF OR RELATING TO (A) THIRD PARTY CLAIMS, ACTIONS OR ALLEGATIONS OF INFRINGEMENT BASED ON INFORMATION, DATA OR CONTENT YOU SUBMITTED IN CONNECTION WITH THE SERVICE, (B) ANY FRAUD, MANIPULATION OR OTHER BREACH OF THESE TERMS BY YOU, OR (C) THIRD PARTY CLAIMS, ACTIONS OR ALLEGATIONS BROUGHT AGAINST INKAKINADA ARISING OUT OF YOUR USE OF THE SERVICE OR THE SITE.

General Information

These Terms are governed in all respects by the laws Government of India, without reference to its conflicts of laws, principles and any dispute arising hereunder shall be submitted to the jurisdiction of Kakinada Court and you consent to the exclusive jurisdiction of such courts. If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. InKakinada's failure to act with respect to a breach by you does not waive InKakinada's right to act with respect to subsequent or similar breaches. You may not assign or transfer these Terms or any rights hereunder, and any attempt to the contrary is void. These Terms shall inure to the benefit of and be binding upon each party's successors and assigns. InKakinada shall not be liable for any delay or failure to perform resulting directly or indirectly from any causes beyond InKakinada's reasonable control. Any notice required or given to you under these Terms shall be delivered by electronic mail at the e-mail address provided by you during registration. These Terms constitute the complete and exclusive understanding and agreement of the parties relating to the subject matter hereof and supersedes all prior understandings, proposals, agreements, negotiations, and discussions between the parties, whether written or oral.

Professional User*

All fees non-refundable, in whole or in part, even if the Service is suspended, or canceled prior to the end of your monthly or annual plan.

For a trial version, if you do not cancel the Service before the Free Trial Period expires, and you have been informed you that the Service will automatically be converted into a paid subscription at the end of the Free Trial Period, then you authorize InKakinada to charge your credit card the applicable fees as indicated at the time you signed up for the Service.

Annual subscriptions automatically renew upon expiration. This means that unless you cancel your account or change its renewal settings prior to its expiration, your account will automatically renew for another year. At the time of renewal, your credit card will be charged the then-current fees to renew the Service. About thirty (30) days prior to the expiration date of your service, the company will notify you by using your email address on file, that your account is about to renew and remind you that your credit card will be billed the indicated Service fees on the renewal date.

Payment Methods

Credit, Debit, and Check Cards

Whether you order online to InKakinada, you may pay by credit, debit, or check card. When you provide InKakinada with your card information, InKakinada will obtain a pre-approval from the card company for the amount of the order, which may result in a corresponding block on your available credit while the pre-approval remains in place. InKakinada will not bill your credit card or process a transaction under your debit or check card until your order is delivered.

Order Processing

The estimated delivery date on your order is based on product availability, payment processing time, and warehouse processing time and does not include transit time. InKakinada does not begin payment processing until InKakinada receives all of the information that it needs and full payment or a full authorization, in the case of credit card, Barclaycard Financing Visa card.

InKakinada will begin payment processing for orders placed on Sundays or holidays on the next business day. Business days are Monday through Saturday, excluding government holidays.

Prices

The InKakinada Store endeavors to offer you competitive prices on our third-party products. Your total order price will include the price of the product on the day of delivery plus any applicable sales tax and delivery charges. InKakinada reserves the right to change prices for products displayed at the InKakinada Store at any time and particularly to correct pricing errors that appear on the Store.

Product Availability

InKakinada makes every effort to deliver your product according to the estimated lead times provided by the InKakinada Store at checkout. The estimated lead times are in business days (Monday through Saturday, excluding government holidays).

Although InKakinada makes every effort to ship your order according to the lead time provided, delivery dates may change due to changes in supply. If the lead time changes, InKakinada will contact you via email and provide a revised delivery estimate.

Return and Refund Policy

Since our company is offering irrevocable and perishable goods we do not issue refunds after the product is delivered, which you are responsible for understanding upon purchasing any article at our site. We only make exceptions with this rule when the product appears to be not-as-described on a case by case basis in agreement of the parties concerned. The deadline for any refund claim is within 24 hours of the delivery. • InKakinada is not responsible for typographical errors. InKakinada reserves the right to cancel any order you have placed if there was a    typographical error on the InKakinada Store concerning the pricing or availability of any item you ordered when you placed the order.
• InKakinada reserves the right to change the terms and conditions of sale at the InKakinada Store at any time.
• InKakinada may make changes to any products or services offered at the InKakinada Store, or to the applicable prices for any such products or    services, at any time, without notice. • InKakinada´s failure to insist on or enforce strict performance of these policies shall not be construed as a waiver by InKakinada of any    provision or any right it has to enforce these policies, nor shall any course of conduct between InKakinada and you or any other party be    deemed to modify any provision of these policies.
• These policies shall not be interpreted or construed to confer any rights or remedies on any third parties.
